Terms of service

These terms govern your use of mobilehomelistingsusa.com and everything on it (the “Service”), run by Mobile Home Listings USA (“we,” “our,” or “us”). We've tried to write them plainly.

The short version: we are a listing and directory platform. We are not a party to any sale, we don't inspect or certify the homes advertised here, and buyers and sellers are responsible for their own transactions.

Acceptance of these terms

By accessing or using the Service you agree to these terms and to our privacy policy. If you don't agree, please don't use the Service.

Eligibility

You must be at least 18 years old and legally able to enter a contract to create an account, submit a listing, or submit a dealer profile. If you are using the Service for a company, you confirm you are authorised to act on its behalf.

What the Service is

Mobile Home Listings USA is a marketplace for mobile and manufactured homes in the United States. We provide:

  • Listings posted by private owners, dealers, and park managers
  • Listings our team writes up from public Facebook Marketplace posts, which send buyers to the original post (see below)
  • A directory of mobile home dealers and parks
  • Comments on listings and dealer profiles
  • Paid placement for listings and dealer profiles

Our role in transactions

This is the most important section in these terms. We are a venue for advertising homes and finding dealers. We are not a broker, dealer, agent, escrow service, lender, insurer, or inspector, and we are not a party to any agreement between a buyer and a seller.

Specifically, we do not:

  • Inspect, appraise, certify, or verify the condition of any home advertised here
  • Guarantee that a listing is accurate, current, still available, or legitimate
  • Verify that a home complies with the HUD Code, state or local building codes, ANSI standards, or local zoning rules
  • Provide legal, tax, financing, insurance, or zoning advice
  • Handle payments between buyers and sellers, or hold funds in escrow
  • Guarantee that any sale, delivery, or transfer of title will happen
  • Endorse any seller or dealer. Badges reflect limited status signals, and are not a warranty about the home or the business.

Any warranty on a home comes from the seller or dealer, not from us. Deal directly and carefully: inspect in person or hire a professional inspector, confirm ownership and title, check the HUD data plate and certification label, confirm whether the home sits on rented park land and whether the park must approve a new owner, verify zoning and moving and setup requirements for your area, and be cautious of anyone who pressures you into a deposit or an off-platform payment.

Accounts

Registration

Some features need an account. Give accurate information and keep it current. You may register with an email address and password, or sign in with Google.

Security

Keep your password confidential. You are responsible for activity under your account, and you agree to tell us promptly at info@mobilehomelistingsusa.com if you think someone else is using it.

Listings and dealer profiles

When you submit a listing or a dealer profile, you are responsible for everything in it. You confirm that:

  • You own the home or business, or are authorised to advertise it
  • Details such as price, size, year, condition, features, and location are accurate and not misleading
  • You own the photos you upload, or have permission to use them, and they show the actual home or work being advertised
  • Any licence, insurance, or certification you claim is real and current, and you'll provide proof if we ask
  • You will keep the listing current and mark it sold when it sells
  • Advertising the home is legal where you are

Submissions are reviewed before publication. Review is a basic check for completeness and policy compliance, not a verification of accuracy, and approval doesn't make us responsible for the content. We may edit formatting, crop or optimise photos, correct obvious errors, and categorise your listing so it displays properly.

Listings based on Facebook Marketplace posts

Some listings on the Service are written by our team from public Facebook Marketplace posts. We restate the facts in the post, such as price, year, size, bedrooms, bathrooms, and location, in our own words, and we leave out the seller's name and phone number. These listings carry a View on Facebook link, and buyers contact the seller there, not through us. We are not the seller and don't represent the seller.

The original post is the authority. If the details differ, or the home has sold, the Facebook post wins. If you posted the home on Facebook and want our listing corrected or removed, email info@mobilehomelistingsusa.com with the listing URL and we will act on it promptly.

Content you submit and the licence you give us

You keep ownership of the text, photos, videos, and other content you submit with a listing or dealer profile. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, copy, resize, crop, adapt, publish, and display that content, with or without your name, in order to:

  • Show it on our website and apps, in search results, feeds, and share previews
  • Post it on social media accounts we run now or in future
  • Use it in advertising for your listing or for the Service, including paid ads on platforms such as Facebook, Google, and Microsoft
  • Include it in our emails and newsletters
  • Create thumbnails, previews, and promotional graphics

We may let the companies that host our content or run these channels use it only as needed to show it for us. You confirm you have the right to grant this licence, including for any photos taken by someone else.

The licence lasts while your content is on the Service. When you remove a listing or it sells, we stop using its content in new posts, ads, and emails, but posts, ads, and emails already published may stay up, and backups and caches may take a reasonable time to clear. The licence doesn't transfer ownership, and it doesn't let us sell your photos on their own. To ask us to take down a specific post, email info@mobilehomelistingsusa.com.

Prohibited content and conduct

Don't use the Service to:

  • Post false, misleading, fraudulent, or bait listings, or advertise homes you can't sell
  • Impersonate anyone, or claim a business you don't represent
  • Upload photos, text, or trademarks you don't have the rights to
  • Harass, threaten, defame, or discriminate against anyone
  • Post obscene, sexually explicit, or violent material
  • Send spam or unsolicited commercial messages to users, sellers, or dealers
  • Scrape, crawl, or bulk-copy listings, photos, or contact details
  • Harvest contact information for marketing or resale
  • Circumvent our review process or create accounts to evade a suspension
  • Probe, attack, or disrupt the Service, or upload malicious code
  • Use the Service for anything unlawful

Listing a home is free. Some listing and dealer features are offered on paid plans. The plan, price, and what it includes are shown before you pay. Payments are handled by Stripe, and we never receive your card details.

  • Premium listings are a one-time payment, not a subscription. Premium placement and the Trusted Seller badge last 90 days from purchase. After that the listing stays up on the Free plan, and photos you already added stay on it
  • A sale price, such as a Black Friday price, applies to purchases completed before the sale end date shown on the site. After it ends, the regular price applies to new purchases. The price you pay is the one shown at checkout
  • Paid dealer plans are monthly subscriptions that renew automatically until cancelled. You can cancel at any time from your billing portal. Cancellation stops future charges and takes effect at the end of the month you've already paid for
  • Fees are for placement and features on the Service. We charge no commission on the sale of your home, and we take no cut of what a buyer pays you
  • Paying does not guarantee a sale, a minimum number of views or leads, any particular search ranking, or a specific time to sell
  • Payments are generally non-refundable except where the law requires otherwise or we agree in writing
  • If we remove your listing for breaking these terms, we may do so without a refund

We may change plans or pricing. Changes won't affect what you've already paid for, and we'll tell dealer subscribers before a renewal at a new price.

Comments

Signed-in users can comment on listings and dealer profiles. Keep comments honest and based on real experience. Don't post comments about your own business, pay for them, or post them about competitors. We may remove content that looks fake, retaliatory, or off-topic.

Intellectual property

The Service itself, including our name, logo, site design, written content, tools, and compilations of listings, belongs to us or our licensors, and is protected by copyright and trademark law. Don't copy, republish, or build a competing database from it without our written permission.

Copyright and image complaints

If you believe content on the Service infringes your copyright or uses your photos without permission, email info@mobilehomelistingsusa.com with:

  • The URL of the page containing the material
  • A description of the work you say was copied, and where your original appears
  • Your name and contact details
  • A statement that you believe in good faith the use isn't authorised, and that the information in your notice is accurate

We investigate complaints and remove infringing material where appropriate. We may pass your notice to whoever posted the content, and we may end the accounts of repeat infringers.

Moderation, removal, and termination

We may review, edit, refuse, or remove any content, and suspend or close any account, if we believe these terms have been broken, the content is unlawful or misleading, a rights holder or authority has asked us to, or the Service or its users are at risk. Where it's reasonable we'll tell you why and give you a chance to fix it.

Anyone can report a listing or comment by emailing info@mobilehomelistingsusa.com with the page URL. We review reports and remove content, and close accounts, that break these terms.

You may stop using the Service and delete your account at any time, from your dashboard or by following our data deletion instructions. Sections that should outlive the relationship, such as content licences for material already published, disclaimers, limitation of liability, and indemnification, survive termination.

Third-party links and services

The Service links to dealer websites, Facebook Marketplace posts, and other resources. We don't control those sites, don't endorse them, and aren't responsible for their content, products, or practices.

Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that listings, dealer details, pricing information, or guides are accurate, complete, or current.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost sales, lost data, or loss of goodwill, arising from your use of the Service, even if we were told such damages were possible.

We are also not liable for the conduct of any buyer, seller, dealer, or other user, including misrepresentation, non-delivery, defects in a home, disputes over deposits or title, or fraud committed by someone you met through the Service.

Where liability can't be excluded, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Indemnification

You agree to indemnify and hold harmless Mobile Home Listings USA and its officers, directors, employees, and agents from claims, damages, losses, and reasonable costs arising out of content you submit, your use of the Service, your breach of these terms, or a transaction or dispute between you and another user.

Changes to the Service and these terms

We may add, change, suspend, or discontinue parts of the Service at any time. We may also revise these terms; the current version is always on this page with its date, and continuing to use the Service after a change means you accept it. If a change materially reduces what you get on a paid plan, you may cancel.

Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute relating to these terms or the Service will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to those courts' jurisdiction.

General

  • Severability. If a provision is unenforceable, it is narrowed to the minimum extent needed, or severed, and the rest stays in force.
  • No waiver. Not enforcing a provision isn't a waiver of it.
  • No partnership. Nothing here creates a partnership, agency, franchise, or employment relationship.
  • Entire agreement. These terms and our posted policies are the whole agreement between us about the Service.
  • Assignment. You may not transfer your rights under these terms without our consent; we may assign them in a merger or sale of the business.
